  • Your circumstances are assessed by the provider you are introduced to, which is responsible for determining whether an IVA may be appropriate for you.
  • Your income, expenditure, debts, assets and creditor position are reviewed.
  • If an authorised provider determines that an IVA is appropriate for your circumstances, a formal IVA proposal may be prepared and sent to creditors for voting.
  • An IVA requires creditor approval and is administered by a licensed insolvency practitioner. Fees apply and should be explained to you before you decide whether to proceed.
  • If approved, creditors bound by the IVA are generally prevented from recovering debts covered by the arrangement outside its terms.
  • You make the agreed payments required by the IVA. The arrangement commonly lasts for several years.

What happens if you take this plan?

  • A DMP provider reviews your income and expenditure to calculate a payment based on what you can afford.
  • A proposal may be made to creditors asking them to accept reduced payments.
  • You normally make one payment each month which is distributed to the creditors included in the plan.
  • You normally repay the debts included in the plan in full. Reduced payments may mean that repayment takes longer.
  • Creditors do not have to freeze interest or charges or stop recovery action because a DMP is an informal arrangement.
  • Making reduced payments can affect your credit record.
  • The plan can be reviewed if your circumstances change.
  • Free DMP providers are available, so you do not have to pay a fee for a DMP service.

What happens if you take this plan?

  • Bankruptcy is a serious formal insolvency process. You should obtain appropriate debt advice before deciding whether to apply.
  • Bankruptcy can affect your home, other assets, income, bank account, employment in some occupations and your credit record.
  • In England and Wales, you apply for bankruptcy online. The current application fee is £680.
  • The Official Receiver or a trustee may take control of certain assets and may deal with your interest in your home.
  • Depending on your disposable income, you may be required to make payments from your income for a period of time.
  • Bankruptcy does not write off every type of debt. Some debts remain payable.
  • You are normally discharged from bankruptcy after a set period, although some restrictions, payments or other obligations may continue beyond discharge.
  • Bankruptcy can stay on your credit reference file for six years from the date of your bankruptcy. Restrictions also apply while you are bankrupt.
  • Many debts included in the bankruptcy may be written off on discharge, subject to the applicable rules and exceptions.
